Terms & Conditions
These Terms & Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the Terms & Conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms & Conditions. Please retain a copy for your information.
The Promoter takes data protection seriously. By entering in this promotion, you confirm that you have read the Privacy Policy, and agree to these Terms & Conditions of the promotion. By submitting any information required as part of their participation into the campaign, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and Data Protection Act 2018.

Eligibility
- The promotion is open to United Kingdom (England, Scotland, Wales and Northern Ireland), Isle of Man, Channel Islands and Republic of Ireland residents aged 18+ only and excludes employees and the immediate families of Nestlé UK Ltd (“the Promoter”), LNCD UK, its affiliated companies, agents or anyone else professionally connected to the promotion.
- Internet access required.
- Purchase necessary. Please retain promotional pack(s) and receipt(s) as proof of purchase showing date of purchase during the Promotional Period.
- No Purchase Necessary mail in option in Northern Ireland.
- Daily winners must hold a UK or ROI bank account
- Maximum two (2) entries per person per day and maximum of one (1) prize type/person & maximum of one (1) prize type/household. For clarification and avoidance of doubt a prize tier is either 1x top tier prize: voucher for sunshine holiday worth up to €/£10,000; or 1 x second tier prize: €/£1,000. A maximum of one of each of these can be won by a person or a maximum of one of each of these can be won by a household only during the total promotional period.
- Entries (bulk or otherwise) made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this or any other condition by, for example, the use of programme, application, script, brute force or any other automated means, that person's entries will be disqualified, and any prize awarded will be void.
- Each entry to the promotion must have a new pack and unique receipt as part of the entry requirements. Anyone trying to circumvent these rules stated in the Terms & Conditions by using alternative details will be disqualified from this promotion.
Promotional Period
- The main promotional period for entry to win one (1) of five (5) sunshine holidays is from 00:00 13.09.21 – midnight 07.11.21. All valid entries will be entered into a prize draw at the end of the main promotional period and the 5 sunshine holiday winners will be drawn at random. Daily draws will also take place each day during the main promotional period, from all valid entries received on the respective day only, for the chance to win a €/£1,000 prize.
- After the main promotional period, there will still be an opportunity to win 1x sunshine holiday or one of 2x €/£1,000 prizes in each of the two late entry draws:
- The first late entry draw period will run between 00:00 on 08.11.21 and midnight on 13.02.22.
- The second late entry draw period will run between 00:00 on 14.02.22 and midnight on 13.09.22.
- Entries during the main promotion, depending on times will be accepted into the relevant daily promotional draws. Entries are valid for the applicable daily draw only and will not roll over. Each promotional day will run from 00:00 to midnight throughout the promotional period. As part of the main entry, participants will also have a chance to win 1 of 5 sunshine holidays (worth €/£10,000 each) in the form of a holiday voucher. This draw will take place at the end of the main promotion, within 2 days of the promotion ending, from all valid entries received throughout the main promotion.
After the main promotion participants will only be allowed to enter into a late entry draw. Entries are valid for the applicable draw only and will not roll over. - Entries received before the main promotion opening date and after the closing dates of the late entry draws will not be accepted into the relevant promotion draws detailed.
Entry Requirements
- There are 56 daily prizes of €/£1,000 available to be won via a randomly selected daily prize draw, during the main promotional period.
Please note that 1 (one) winner will be randomly selected each day (56 in total). All valid entries will also be entered into the prize draw at the end of the main promotional period for a chance to win one (1) of five (5) sunshine holidays. - To enter the promotion for a chance to win in the daily prize draw, consisting of €/£1,000 and also to be entered into a prize draw to win a voucher for a sunshine holiday worth up to €/£10,000 at the end of the main promotion period, participants must:
- Purchase a participating promotional pack of Nestlé sharing bags or blocks, or a Lactalis dessert, whilst stocks last (see clause 20 for participating products);
- Visit www.nestle-promotions.co.uk/sofatosunshine or scan the QR code on the back of selected packs to be taken directly to the promotional microsite
- Enter their full name, email address, county & country of residence and the last 4 digits of the barcode found on the back of the promotional pack to be entered into the daily prize draw to win €/£1000. All valid entries will also be entered in to a prize draw to win a sunshine holiday voucher worth up to €/£10,000:
- Entrants into the main promotional period will be entered into the daily prize draw to win €/£1,000. Daily draws during the week (Monday to Thursday) will be drawn the next working day. The daily draws on a Friday, or during weekends, will also be drawn the following working day, the Monday.
- The final prize draw to win a sunshine holiday will be drawn from all valid entries throughout the main promotional period and the winners will be notified, by email, the next working day after the draw has taken place.
- Entrants into any late entry draws will be entered into their respective late entry prize draw and will be notified, by email, within 2 weeks of each closing date if they are a winner.
- All daily prize draw winners will be asked to follow the instructions within the email for verification and to claim their €/£1,000 prize. All Sunshine Break holiday winners will be asked to follow the instructions within the email for verification and to claim their €/£10,000 voucher prize.
- Please retain your promotional pack containing the barcode and itemised receipt showing date of purchase during the Promotional Period for each entry as you will require these for verification purposes.
- Each receipt can only be used once. Entrants who do not give correct details, provide inaccurate or the wrong or incorrectly dated receipts or those who make an entry on someone else's behalf will be disqualified.
- Incomplete, illegible, misdirected or entries received outside any promotional period will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.
- To enter without purchase in Northern Ireland only – send your name, age, full postal address and email address to: Nestlé Sunshine Break Promotion NPN, Consumer Services, Nestlé UK Ltd, Haxby Road, York, YO91 1XY. Once the request has been verified, a 4-digit promotional code will be provided via email within 2 working days, which can then be entered on the microsite in order to enter the promotion. Only one entry per stamped, correctly mailed envelope. A maximum of 2 entries per person throughout the promotional period. No Purchase Necessary applications must be received by the Promoter no later than 06.09.22 to allow entry into the promotion.

Prize Details
Top tier: Sunshine Break voucher worth up to £/€10,000
- Total of 7 Sunshine Breaks to be won:
- 5x Main period (1x Prize draw): 00:00 13.09.21 – midnight on 07.11.21.
- 1x First late entry period: 00:00 08.11.21 - midnight on 13.02.22.
- 1x Final late entry period: 00:00 on 14.02.21 - midnight on 13.09.22.
- Sunshine Break prizes will be awarded in the form of a voucher. The voucher may be used to book multiple sunshine holidays so long as:
- The total cost of a single holiday is no less than €/£2,500.
- The total cost redeemed against the voucher does not exceed €/£10,000.
- If the total cost of the winners Sunshine Break/s exceeds €/£10,000, the winner will need to cover any and all additional costs. All Sunshine Breaks booked using a voucher are subject to availability and certain dates may be excluded. All holidays must be booked within 12 months of winner notification and travel must be completed within 24 months of winner notification. Once booked any amendments will be at the expense of the winner. Any vouchers not used within the timings stated above will be voided.
- The Promoter will appoint their Prize Provider, Element London, to act as the winner's personal experience advisor who will provide expert and impartial advice to provide travel, accommodation, excursions and other activities requested by the winner to the value of €/£10,000. Once an itinerary has been agreed the holiday booking, including any trips, excursions or experiences, must be made through Element London, the prize provider. All travel arrangements offered are at the discretion of the Promoter and prize provider. Any transfers, meals and drinks, excursions, attractions, treatments, car hire, personal expenses, and all other costs and arrangements not expressly included in the agreed itinerary will be at the expense of the winner.
- T&Cs specific to chosen hotels, cruises, flights or excursions may apply. These will be provided to the winner prior to prize being taken.
- No cash alternative will be offered. Vouchers are non-negotiable, non-transferable and non-refundable in part or in full. If the Sunshine Break booking made in connection to this voucher is cancelled by a winner, only monies paid in addition to the value of the voucher will be subject for refund and only if permitted under the cancellation terms. If the value of the Sunshine Break against which the voucher is redeemed is less than the face value of the voucher, the winner will be allowed to use the remaining voucher value towards another holiday. In the event for any reason the user does not take any element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the user and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize, unless otherwise agreed.
- Where the trip involves foreign travel, the winner and travel companion(s) are responsible for obtaining a current and valid passport and any other relevant travel documentation or visas required for travel to their chosen destination at their own expense.
- Where hotel accommodation is included in the trip, the winner will need a current and valid credit/debit card with sufficient available funds in order to check in at the hotels for security deposit purposes.
- Prize Winners will be responsible for any other incidentals on their booked holiday/s and in the hotel.
- Where the trip involves foreign travel, winners will need to have travel insurance. They will be able to accommodate the cost of travel insurance within the €/£10,000 prize cost should they wish to do so.
- The Prize Provider will not organise travel to countries or areas the British Foreign & Commonwealth Office advise against travel due to safety concerns, and will not organise travel to countries stated as being 'red' in line with the Government guidelines surrounding Covid-19 restrictions.
- Winners and their guests must adhere to Government guidance and travel requirements in line with ongoing Covid-19 restrictions, including the necessary Covid-19 testing and vaccinations required in order to travel to/from their desired destination. Winners are able to accommodate the cost of purchasing vaccinations and the necessary Covid-19 testing kits within the €/£10,000 prize cost should they wish to do so.
- Winners and their guests take full responsibility for any risks associated with traveling to, in and from their Sunshine Break destination/s or departing country. The Promoter will (with the Winners and guests) take into account any travel advice from the UK Government to ascertain whether there are any issues with potential travel and will try and assist with suitable alternatives should there be major concerns. The promoter or The Prize Partner can provide advice and recommendations, however they are not responsible for any loss or damage suffered by the Winners and/or travellers in relation to this promotion, the exercise of the prize.
- The prize winner and their guest must be over the age of 18 years, except where the winner is the parent or legal guardian of the accompanying minor. For travel to the USA, at least one traveller must be at least 21 years or over.
- All flight inclusive package holidays booked with the winning vouchers will be ABTA and ATOL protected and will be subject to the full terms and conditions of the holiday provider.
- Prior to booking the itinerary the Prize Provider will inform the winner of any age restrictions and other terms and conditions that may apply to individual elements of their chosen itinerary. It is the responsibility of the winner to adhere to such further terms and conditions including without limitation applicable health and safety guidelines.
- In the event that government restrictions related to the COVID-19 pandemic prohibit a winner from fulfilling their prize on the confirmed date, a full cancellation will be offered and the voucher will be reimbursed allowing the winner to re-book for an alternative date.
- The winner and any potential guests (where applicable) are responsible for and must comply with any health advice/regulations/vaccinations/health certificate/visas and other documentation required by any destination country necessary to complete the itinerary at the time of travel. Any associated costs for this are the responsibility of the prize winner and any potential guests (where applicable) but may be included as part of the voucher value as detailed in clause 32.
- The Winner and their guests must not have any limitations upon their ability or rights to travel to and from both their chosen Sunshine Break destination/s or the departing country. The right to refuse entry to either country is held by Passport control and countries authorities. Promoter or Prize Partners accepts no responsibility for ensuring the Winner or their guests are able to travel and are not responsible for any costs incurred should entry be refused by Passport control or the countries authorities.
Second tier: €/£1,000
- Total of 60x €/£1,000 prizes to be won:
- 56x Daily prize draws (1x Prize per draw): 00:00 13.09.21 – midnight on 07.11.21.
- 2x First late entry period: 00:00 08.11.21 - midnight on 13.02.22.
- 2x Final late entry period: 00:00 on 14.02.21 - midnight on 13.09.22.
- The €/£1,000 prize will be issued via cheque or BACS transfer. A valid postal address is required for the cheque and all relevant bank details are required for BACS payment.
- The prize is non-negotiable and non-transferable.
- For BACS payments, winners must provide their Account Name, Bank, Account Number and Sort Code. ROI winners must also supply their IBAN Number.
- For cheque payments, winners must provide their address details. Cheques will be issued as a single £1,000 to U.K., IoM or CI winners or a single €1,000 cheque to winners in the Republic of Ireland.
- For all £/€1,000 prize payments, cheques will be sent via Royal Mail, Signed For 2nd Class and please allow 28 days for receipt of prize after claim and verification. Winners in Ireland will have their cheques sent via International Tracked and Signed For postage.
- Once the cheque has been issued and delivered to the winner's address it is the responsibility of the winner to cash the prize and immediate deposit is recommended. The promoter will not issue any replacement cheques.
- There are 67 (7x €/£10,000 Sunshine Break Holiday Vouchers & 60x €/£1,000) prizes available in total.
Winner selection and notification
- A total of five sunshine holiday winners and 2 reserves will be drawn within 3 working days of the main promotional period from all genuine, valid entries via an independently verified process.
- The winners of the Second tier daily €/£1,000 prize and 2 reserves will be randomly selected from all genuine, valid entries, every day via an independently verified process.
- The daily draws during the week (Monday to Thursday) will be drawn the next working day. The daily draws on a Friday, during weekends will also be drawn the following working day, the Monday.
- Winners of the main prize draw to win a Sunshine Break voucher worth up to £/€10,000 will be contacted via email the next working day after the draw has taken place. Winners of the daily prize draws will be contacted via email the next working day after the prize draw has taken place. Winners of the late entry draws will be contacted via email within 2 weeks of the relevant draws taking place. All winners will be asked to follow the instructions within the email for verification and to claim their prize.
- Please retain winning communication until any prize has been verified.
- Winners will be subject to a full verification process. Winners will be required to provide their promotional pack with the barcode and also the relevant proof of purchase in order to verify their claim. If the winner has entered multiple times, the Promoter reserves the right to request receipt proof of all of the entries.
- In the event that any winner is ineligible, does not claim their prize within the stated claim period, rejects their prize, is disqualified from the promotion or if any prize is not claimed, the Promoter reserves the right to withdraw their prize which will be forfeited, and a reserve, drawn next in line from the orginal applicable draw will be contacted. If after 3 attempts (main winner & 2 reserves) the prize is not successfully claimed then the promoter reserves the right to include it in the final late entry draw.
- All prize draw winners will be notified of their win via the email provided on entry, to confirm the claim process. Winners will have 14 days to claim their prize from first contact. There will be a request for further information such as proof of ID and address, together with the purchased promotional pack details and proof of purchase as detailed above. If the winner has entered multiple times, the Promoter reserves the right to request receipt proof and promotional pack of all the entries.
- If more than one person from the same household has won the same prize then the second drawn winner will be deemed ineligible and their prize will be awarded to the first reserve.
- Following verification, winners of the €/£1,000 prize will be requested to confirm how they would like to receive their prize i.e. by cheque or BACS transfer. Winners will be requested to provide personal details to allow their cash prize to be fulfilled by cheque or BACS transfer.
- If winners select cheque as their preferred claim method, winning cheques must be sent to a winner's permanent UK, IoM/CI or ROI residence and immediate deposit is recommended.
- Once verified by an independent third party, Top Tier prize winners only will be contacted via phone within 7 days in order to confirm their win has been verified & confirm next steps in order for them to book their chosen Sunshine Break.
- 1x Sunshine Break winner, 2x €/£1,000 winners and reserves will be drawn in each late entry draw (and in addition any unclaimed prizes) and winners only will be contacted via the email provided on entry within 2 weeks of each of the late entry draws closing dates, following the same process as the main promotional period.
- 1x First late entry period: 00:00 08.11.21 - 23:59 on 13.02.21.
- 1x Final late entry period: 00:00 on 14.02.22 - 23:59 on 13.09.22.
- Any remaining prizes not won or any prizes that remain unclaimed following the close of the main promotional period will be incorporated into the late entry draws. Where a prize is not claimed the Promoter reserves the right to further contact reserves to fulfil any prizes not claimed in this instance, with the original winner being withdrawn and the prize forfeited. If this process is not successful in contacting winners or reserve winners after 2 reasonable attempts to do so then any remaining prizes not won or any prizes that remain unclaimed following the close of the final late entry draw will be declared null and void. Any prizes left unclaimed at the end of January 2022 will be forfeited and re-entered into the prize pool for the first late entry draw. Following this, any prizes left unclaimed at the end of June 2022 will be forfeited and re-entered into the prize pool for the final late entry draw.
- All winners will first have to be verified, following receipt of information. Once verified they will then be contacted by a third-party operator to redeem their prize or receive their €/£1000 following the same process as the main promotional period.

General
- The Promoter's decision is final with regard to all promotional matters.
- Any and all costs incurred by obtaining time off from work or study to take part in the promotion or the main promotional prize are the responsibility of the winner. The Promoter accepts no responsibility for costs incurred.
- The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person's negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
- All entrants will be required to provide a genuine email address that is personal, valid and accessible throughout the promotion. In the event that the specified information is not provided or is incorrect or an alias, the entry may be considered incomplete and therefore the Promoter reserves the right to invalidate the entry.
- In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.
- Last 4 digits of the barcodes must be entered online exactly as they appear on the pack. Each barcode that is entered on the promotional microsite must be a separate purchase with a corresponding itemised receipt in order for the entry to be valid. Please retain for any prize claim.
- Barcodes have no value and cannot be transferred or sold.
- In ROI this promotion is carried out under the license issued to Pieta House, Pieta House Cork, Shanakiel, Cork.
- Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:
- Any incorrect or inaccurate entry, or for any faulty, erroneous or failed electronic data transmissions;
- Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;
- Inaccessibility or unavailability of the internet or the microsite or any combination thereof;
- Any unauthorised access to, or theft, destruction or alteration of barcodes at any point during the operation of this promotion;
- Any damage, injury or loss of earnings incurred directly or indirectly in relation to this promotion.
- Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the QR code redemption process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms & Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
- If, due to unforeseen circumstances, the prize is not available, the Promoter reserves the right to substitute another prize for it, in its sole discretion, of equal or higher value. Unless otherwise agreed in writing by the Promoter, the prize will only be awarded directly to the participant.
- If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion modify or suspend the competition or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
- The Promoter reserves the right to verify all entries including but not limited to asking for address and indentity details (which they must provide within 14 calendar days) and to refuse to award a prize or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion's entry requirements or otherwise, where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter for all decisions, which are final and binding. It will not respond to any correspondence.
- By taking part in the promotion, winners agree that Nestlé may contact them to ask whether they want to participate in reasonable marketing activities and publicity relating to the promotion. Such publicity may include, without limitation, the entrants name and/or if consent given, image or statements made by the entrants concerning the promotion and/or prizes obtained as part of the promotion. Winners are not obliged to agree to any request.
- Subject to Nestle's Privacy Policy, the surnames and counties of verified winners of the Sunshine Break and €/£1,000 prizes will be available upon request by sending an email request to consumer.services@uk.nestle.com with the subject line 'WINNERS LIST: WIN a Sunshine Break Promotion', for a period of 3 months following the end of the promotion. When contacting this email address, your request will be actioned in line with Nestlé's Privacy Policy. The Promoter reserves the right to refuse any or all such requests. If any winner objects to their information being published, then they can contact the Promoter by emailing UKI.Dataprotection@uk.nestle.com with the subject line 'Win a Sunshine Break promotion'. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so.
- The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person's negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
- If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms & Conditions and the remaining clauses shall survive and remain in full force and effect.
- The Promotion and these Terms and Conditions will be governed by the laws of the participating country but any disputes as to the meaning of these terms will be subject to the exclusive jurisdiction of the participant's local courts.
Data Protection
- The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. The surnames and counties of verified winners will be made available as set out in Clause 74 above and winners can object to this by emailing UKI.Dataprotection@uk.nestle.com.
