Full Terms & Conditions

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the Terms and Conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.

The Promoter takes data protection seriously. By entering in this promotion, you confirm that you have read the Privacy Policy, and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation into the promotion, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and Data Protection Act 2018.

Eligibility

  1. This promotion is open to United Kingdom (England, Scotland, Wales and Northern Ireland), residents aged 18+ only and excludes employees and the immediate families of J Sainsbury plc and Nestlé UK Ltd (“the Promoter”), its affiliated companies, agents or anyone else professionally connected to the promotion.
  2. No purchase necessary. Internet access required.
  3. There is a maximum of 1 x prize type per person and a maximum of 1 x prize type per household available to be won.
  4. Entries (bulk or otherwise) made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this or any other condition by, for example, the use of programme, application, script, brute force or any other automated means, that person's entries will be disqualified, and any prize awarded will be void.

Promotional Period

  1. The promotion is open from 20.11.24 – 10.12.24.
  2. Access to the QR code featured in participating Sainsbury's stores is only available within participating stores when open. Daily store hours will vary, check your local store for details. See appendix for store list.

Entry Requirements

  1. To enter, for your chance to win 1 x £20 Sainsbury's e-gift card (winning moment daily prizes) or 1 x trip to see the Northern Lights (worth up to £4,500 plus £500 spending money) in the prize draw, participants must:
    1. Scan the QR code featured on the Quality Street® fixture instore across participating Sainsbury's stores during the promotional period.
    2. Once scanned, the site will load on the smartphone and entrants will be asked to input their name, email address and county, and confirm that they are aged 18+ and have read and have understood and accepted the Terms and Conditions.
    3. Entrants will find out immediately if they are an instant online winner of a £20 Sainsbury's e gift-card
    4. All entrants (if they have won or not) will be automatically entered into the prize draw for a chance to win a trip to see The Northern Lights.

Prizes Details

  1. There are 525 x £20 Sainsbury's e-gift cards available to be won online via winning moments (25 X per day during the promotional period).
  2. Each £20 Sainsbury's e-gift card cannot be used towards Branded gift cards, lottery related products, Pay Point products and services, Stage 1 Infant Formula milk, Tobacco and related products, postage stamps, all in store concessions, Petrol and Diesel, Mobile phone top ups and travel money.
  3. Sainsbury's e-gift cards can be used to purchase products in all Sainsbury's stores, including TU clothing and homeware, as well as in Sainsbury's coffee shops. E-gift cards are redeemable online for Sainsbury's Groceries only and cannot be used to be pay for delivery charges.
  4. No cash alternative will be offered. The prize is non-negotiable, non-transferable and non-refundable in part or in full. The gift card will be subject to terms of use found at: https://help.sainsburys.co.uk/help/terms-and-conditions/giftcardtcs.
  5. There is 1 x trip to see the Northern lights for 4 (two adults, two children) available to be won in a prize draw at the end of the promotional period.

  7. Trips available are for up to 4 people (two adults, two children) up to a value of £4,500 plus £500 spending money. The £500 spending money will be issued via BACs transfer. The winner must provide all relevant bank details for BACS payment to Cloud Nine Incentives, including their Account Name, Bank Account Number and Sort Code.
  8. The dates for the trip can be taken in half term but cannot be taken over the actual Christmas period which would be from 22nd December 2025-2nd January 2026. All travel is subject to availability.
  9. Please note, due to the unpredictability of the Northern Lights, there is no guarantee that winners will see them on their agreed trip, therefore, there will be no opportunity to request a refund or receive compensation if they are not visible on the winner's trip.
  10. Following the prize draw, the winner will be contacted by Cloud Nine, who will share the available experiences to choose from. Cloud Nine will then work with each winner to book their Northern Lights trip to the maximum value of £4,500 plus £500 spending money).
  11. If the total cost of the winner's booked Northern Lights experience exceeds £4,500 (not including £500 spending money), the winner will need to cover any and all additional costs.
  12. All Northern Lights trips must be agreed and completed within 12 months of winner notification. Once agreed any amendments will be at the expense of the winner. Please allow, where possible, a minimum of 6 weeks' notice in which to book your prize – please allow for more time if possible.
  13. All Northern Lights trips are subject to availability and exclusions may apply. Any exclusions will be made apparent to the winner in advance of them selecting their preferred experience.
  14. Any changes made to the booking after confirmation will incur an amendment charge, which will need to be covered by the winner.

  16. Any transfers, meals and drinks, car hire, personal expenses, and all other costs and arrangements not expressly included in the agreed trip will be at the expense of the winner.
  17. Travel insurance is provided by Cloud Nine for winners up to the age of 79 with no pre-existing medical conditions. All health and travel insurance are dealt with on a case-by-case basis and varies depending on age of winner and holiday destination chosen.
  18. No cash alternative will be offered. The prize is non-negotiable, non-transferable and non-refundable in part or in full. In the event for any reason the user does not take any element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the user and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize, unless otherwise agreed.
  19. Age restrictions may apply. The prize winner or their guest (one of whom must be over 18) will need to have a current and valid credit card to check-in at their hotel accommodation for security deposit purposes. The Promoter will take no responsibility for this.
  20. Prior to booking the trip, the Prize Provider will inform the winner of any restrictions and other terms and conditions that may apply to individual elements of their chosen prize. It is the responsibility of the winner to adhere to such further terms and conditions including without limitation applicable health and safety guidelines.

Winner Selection and Notification

Daily Winning Moments

  1. During the promotional period the £20 Sainsbury's e-gift card prizes have been randomly allocated and linked to open 'winning moments' (days, hours, minutes, seconds) which have been randomly pre-selected by a secure independently verified computer programme. There are 525 winning moments available throughout the main promotional period (25 available per day), and the first person to enter and win on or after the allocated winning moment will have been deemed to have won a Sainsbury's e-gift card prize.
  2. Winners of the Sainsbury's e-gift card will be notified instantly online.
  3. Following successful verification, the £20 Sainsbury's e-gift card will be issued electronically within 7 days following win verification and will be supplied to winners via the email address provided on the site.
  4. Any unclaimed winning moments at the end of one day will roll over to the next day but any winning moment prizes remaining at the end of the promotional period will be declared null and void unless claimed.

Prize Draw

  1. For the main prize draw to win a trip to see the Northern Lights, 1 winner will be randomly selected from all genuine, valid entries received throughout the promotion, via an independently verified computer programme. The draw will take place two (2) working days after the promotion closes. Sainsbury's is not involved in the running of the prize draw.
  2. The winner of the trip to see the Northern Lights will be subject to a full verification process. The winner will be contacted via the email address provided on entry within 7 days of the prize draw and will be asked to provide evidence of identity and eligibility in order to claim their prize. County of residence will be requested for the purpose of the winner's list if no objection is received. If the winner does not respond to the initial contact and subsequent contact within 14 days, the Promotor reserves the right to disqualify that entrant and the reserve will be contacted. If after 3 attempts (1 winner, 2 reserves), the prize is not successfully claimed, then the prize will be declared null and void. Entrants are encouraged to monitor their email accounts during this time in case they are the winner.
  3. After verification, the winner of the prize draw will then be contacted by Cloud Nine Incentives Ltd in order to book their Northern Lights trip as per clauses 12-27.
  4. Incomplete, ineligible, misdirected or invalid entries received outside the promotional period will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

General

  1. The Promoter's decision is final with regard to all promotional matters.
  2. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person's negligence) in connection with this promotion or accepting or using the prizes, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
  3. All entrants will be required to provide a genuine email address that is personal, valid and accessible throughout the promotion. In the event that the specified information is not provided or is incorrect or an alias, the entry may be considered incomplete and therefore the Promoter reserves the right to invalidate the entry.
  4. In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address. The Promoter cannot be held responsible for any winner failing to supply accurate information which affects prize acceptance or delivery of their prize.
  5. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:
    1. Any incorrect or inaccurate entry, or for any faulty, erroneous or failed electronic data transmissions;
    2. Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;
    3. Inaccessibility or unavailability of the internet or the online form or any combination thereof;
    4. Any damage, injury or loss of earnings incurred directly or indirectly in relation to this promotion.
  6. Conduct of entry:The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the QR code entry process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms & Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
    If, due to unforeseen circumstances, a prize is not available, the Promoter reserves the right to substitute another prize for it, in its sole discretion, of equal or higher value. Unless otherwise agreed in writing by the Promoter, the prizes will only be awarded directly to the winners.
  7. If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, modify or suspend the promotion or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
  8. The Promoter reserves the right to verify all entries including but not limited to asking for address and identity details (passport, driving licence or equivalent) which they must provide within 14 calendar days and to refuse to award a prize or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion's entry requirements or otherwise, where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter for all decisions, which are final and binding. It will not respond to any correspondence.
  9. Subject to Nestlé's Privacy Policy, the surname and county of residence of the Northern Lights winner will be available upon request by sending an email request to consumer.services@uk.nestle.com with the subject line 'WINNERS LIST: Quality Street Sainsbury's 2024', for a period of 3 months following the end of the promotional period. When contacting this email address, your request will be actioned in line with Nestlé's Privacy Policy. The Promoter reserves the right to refuse any or all such requests. If the winner objects to their information being published, then they can contact the Promoter by emailing UKI.Dataprotection@uk.nestle.com with the subject line 'Quality Street Sainsbury's 2024'. The Promoter may nevertheless disclose the information to the Advertising Standards Authority if required to do so.
  10. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
  11. The Promotion and these Terms and Conditions will be governed by the laws of the participating country and any disputes as to the meaning of these terms will be subject to the exclusive jurisdiction of the participant's local courts.

Data Protection

  1. The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. The surname and county of residence of the Northern Lights winner will be made available as set out in Clause TBC above and the winner can object to this by emailing UKI.Dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as applicable. You can request access to your personal data, have any inaccuracies rectified or request deletion of personal data by sending an email to UKI.Dataprotection@uk.nestle.com. By participating in the promotion, you agree to the use of your personal data as described here. You can withdraw your consent at any time. For the purpose of this promotion, requests to delete personal data can only be actioned after the promotion has concluded and the winners accepted their prize. Any data obtained via this promotion will be deleted after 3 months of the promotional end date with the exception of the winners and reserves whose data will be deleted after fulfilment of their prize.
